The report details the condition and damage to a property – both internally and externally. This allows you to find out both major and minor defects – problems which can include issues such as rising damp, movement in the walls (cracking) and potential safety hazards, before it costs you dearly. The information from the inspection will help you avoid expensive repairs and can affect the purchase price.
A timber pest inspection looks for the signs of damage or activity of timber destroying organisms such as subterranean termites, wood boring beetles (borers) and fungal decay (rot). The inspection and report must comply with Australian Standard 4349.3. Our inspectors report on the presence of termites, borers and decay, any damage detected and also record any conducive conditions that may make a future attack more likely.
What is the difference between our standard reports and our risk assessment reports? Our standard report is like most other reports in the strata reporting marketplace. It is a collection of information from the records of the strata manager. It is presented to clients for them to interpret with the help of their lawyers and conveyancers. In other words, it is a data dump. The problem with this type of reporting is that lawyers and conveyancers and certainly their clients are not trained to interpret the information in these reports. That means clients are often not provided with accurate and essential information before they buy into a strata complex. On the other hand, strata inspectors preparing risk assessment reports are trained to interpret this information when providing risk assessment reports. In addition, all the important information is included in an easy-to-read executive summary at the beginning of the report. Before finalising the purchase of a new home or property it is prudent to conduct one or more pre-purchase inspections to ensure that the property is not affected by pest damage (especially termites), building flaws or damage or other potential liabilities.
Pink Inspection Services are prepared to accept instructions and perform any Inspection and Report ordered in accordance with this Agreement but not otherwise.
Access Hole means a hole in a structure which allows entry to a specific area in the Property.
Access hole (cover) means an opening in the structures at the Property to allow for safe entry to carry out an Inspection.
Accessible Area means an area at the Property where sufficient Safe and Reasonable Access is available to allow Inspection within the scope of the Inspection ordered.
Client means the Person(s) or other legal entity for whom the Inspection is to be carried out and identified above. If ordered by the Person(s)’s agent then it is agreed that the agent represents the Person(s) and has the authority to act for and on their behalf. We require the Client to pay any Invoice by Us, unless We agree in writing to the contrary. (See also the words “You/Your” below).
Inspector means the person or organization responsible for carrying out the Inspection. (See also the words “Our/Us/We” below).
Limitation means any factor that prevents full achievement of the purpose of the Inspection.
Loss or Claim means, in relation to any Person or entity, a damage, loss, cost, expense or liability incurred by that Person or entity or a Claim, demand, action, proceeding or Judgment made against that Person or entity, however arising and whether present or future, fixed or unascertained, actual or contingent.
Our/Us/We means Pink Inspection Services or the Person or entity carrying out the Inspection and Report for the Property together with all servants agents employees or third parties engaged for the purposes of Building Inspection and Report by Pink Inspection Services.
Person means any individual, company, partnership or association who is not defined as Our Client.
Property means the structures and improvements up to thirty (30M) metres from the exterior walls of the main building at the Property but within the boundaries of the land on which it is erected.
Property – Strata/Company Title means the interior of any subject in a Strata or Company Title Property but does not include any Common Property or Common Area relevant to that Property.
Report means the document (and any attachments) issued to You by Us following Our Inspection of the property. The Report is deemed to include each of, and be provided under, the terms of this Agreement.
Safe and Reasonable Access does not include any requirement to use destructive or invasive Inspection methods or the moving of furniture or of stored goods.
The Australian Standard AS 4349.1/2007 defines the extent of Safe and Reasonable Access to building areas as follows:
The Inspection WILL NOT involve any invasive Inspection including cutting, breaking apart, dismantling, removing or moving objects including, (but not limited to), roofing, wall and ceiling sheeting, ducting, foliage, mouldings, debris, roof insulation, sarking, sisalation, floor or wall coverings, sidings, fixtures, floors, pavers, furnishings, appliances or personal possessions.
The Inspector CANNOT see or inspect inside walls, between floors, inside skillion roofing, inside the eaves, behind stored good in cupboards, in other areas that are concealed or obstructed. An invasive Inspection will not be performed unless You enter into a further Agreement with Us.
Reasonable Access means only areas to which access is readily available for the purposes of Inspection and does not include the use of destructive or invasive Inspection methods, nor does it include cutting or making access traps or the removal of fastenings such as nails, screws, bolts or sealing materials. Access will not be available where there are safety concerns, obstructions or where the space available is less than the following:
Roof Void – the dimensions of the access hole should be at least 500mm x 400mm, and reachable by a 3.6m ladder, and there is at least 600mm x 600 crawl space.
Roof Exterior – must be accessible by a 3.6m ladder placed on the ground.
Subfloor – access it not normally available where dimensions are less than 500mm x 400mm for the access hold and less than 400mm of crawl space beneath the lowest timber bearer, or less than 500mm beneath the lowest part of any concrete floor.
Note: Our Inspector shall determine whether sufficient space is available to allow Safe Access to confined spaces.
You/Your means the party identified on the first page of this Agreement as the Client, and (where more than one party) all such parties jointly and severally, together with any agent of that party. You agree that in signing this Agreement You have read and understand the contents and effect of this Agreement and that the Inspection will be carried out in accordance with this document. You agree to pay for the Inspection and Report on delivery of the Report.
Where relevant, each of the above Definitions are incorporated into Sections B and C, unless expressed otherwise
You enter into this Agreement and engage Pink Inspection Services to perform through an Inspector nominated by Us the Inspection nominated by You in this Agreement.
Pink Inspection Services:
3.1 are engaged by You, whether or not You act as an agent for any other Person;
3.2 provide the Inspection Report to You as a Client of Pink Inspection Services; and
3.3 require You to pay all Fees and Expenses incurred in the performance of Work by Pink Inspection Services contemplated by this Agreement.
Pink Inspection Services may accept the Engagement by You and will commission and carry out the Inspection and Report ordered by You in accordance with this Agreement immediately upon any of the following events:
4.1 You signing and returning or acknowledging in writing a Copy of this Agreement; or
4.2 You making a request of Us in writing (including an electronic request) to commission an Inspection after You have received a copy of this Agreement; or
4.3 You otherwise indicating Your acceptance of this Agreement either orally, by email, or by checking the acceptance box on our website or otherwise in writing.
Any estimates provided in the Report are merely opinions of possible costs that might be encountered, based on the knowledge and experience of the Inspector, and are not estimates in the sense of being a calculation of the likely costs to be incurred. The estimates are NOT a guarantee or quotation for work to be carried out by any Person. The Inspector accepts no liability for any error in estimates provided throughout this Report. You agree to obtain and rely on independent quotations for the same work, identified in the Report.
We will not be liable for any Loss or Claim, damage, cost or expense, whatsoever, suffered or incurred by any Person other than You in connection with the use of the Inspection Report provided pursuant to this Agreement by that Person for any purpose or in any way, including the use of this report for any purpose connected with the sale, purchase, or use of the Property or the giving of security over the Property, to the extent permissible by law. The only Person to whom We may be liable and to whom any Loss or Claim arising in contract or tort sustained (if any) may be payable by Us is the Client named in this Agreement.
7.1 Prohibition
The Report may not be sold or provided to any other Person without Our express written permission, unless the Client is authorized to do so by Legislation. If We give Our permission it may be subject to conditions such as payment of a further fee by the other Person and agreement from the other Person to acknowledge and comply with this Clause.
However, We may sell or provide the Report to any other Person We choose, although there is no obligation for Us to do so.
7.2 Release
You release Us from any and all Claims, actions, proceedings, Judgments, damages, Loss or Claim, interest, costs and expenses of whatever nature that any Person may have at any time hereafter arising from the unauthorized provision or sale of the Report by You to a Person without first obtaining Our express written permission.
7.3 Indemnity
In the event that you provide or sell to any Person a Report issued by Us to You without Our express written permission then in those circumstances:
7.3.1 You Indemnify Us and continue to Indemnify Us in respect of any and all liability, including any or all Loss or Claim, actions, proceedings, Judgments, Damages, Interest, Costs and Expenses of any nature which may be incurred by, brought, made or recovered against Us; and
7.3.2 which Loss or Claim arises directly or indirectly from your unauthorized use of Our Report to You or any correspondence relevant to this Agreement; and
7.3.3 this Indemnity shall be a continuing Indemnity and shall not merge on conclusion of Our obligations under this Agreement.
7.4 Copyright
To the extent possible at law We claim Copyright over this Agreement in its entirety. Sections of this document have been reproduced with the © Copyright permission of Rapid Solutions Pty. Ltd.
8.1 Dispute
In the event of a dispute or a claim (Dispute) arising out of, or relating to the Inspection or the Report, or any alleged negligent act, error or omission on Our part or on the part of the Inspector conducting the Inspection, both parties must give written notice of the Dispute to the other party (the Dispute Notice). For the purposes of resolving the Dispute:
8.1.1 You must allow Access to and rights to Us to enter the Property for the purposes of the Dispute;
8.1.2 You and Us must act in good faith in attempting to resolve the Dispute; and
8.1.3 any resolution reached with Us must be evidenced in writing and signed by You and Us to be binding on Us.
8.2 Mediation
In the event the Dispute is not resolved within fourteen (14) days from the date of service of the Dispute Notice then either party may refer the Dispute to a duly qualified Mediator and:
8.2.1 upon referral to a Mediator both parties must participate in a Mediation; and
8.2.2 the cost of the Mediation shall be met equally by the parties, or as otherwise directed by a Mediator.
8.3 Arbitration
Should the Dispute not be resolved by Mediation then one or other of the parties may within fourteen (14) days from the date of Mediation refer the Dispute to the Institute of Arbitrators and Mediators of Australia who will appoint an Arbitrator to resolve the Dispute by Arbitration. The Arbitrator will also determine what costs each of the parties are to pay
This Agreement will apply to all or any Inspections and Reports provided by or arranged by Pink Inspection Services for You and shall govern Our Engagement at all times, unless varied or replaced by a document in writing with which We agree.

Pink Inspection Services reserves the Right to terminate this Agreement in the event that You (in our reasonable Opinion) breach any provision of this Agreement.
If You seek Our Services and request something outside the scope of this Agreement We must first accept and agree with Your request before that request becomes part of this Agreement and binds Us.
This Agreement is to be read, interpreted and enforced in accordance with the law of the State of New South Wales.
If You engage Us to carry out a Building Inspection and Report at the Address nominated by You Section A and the following further provisions of Section B will apply to this Agreement.
Acceptance Criteria – The Building shall be compared with a building that was constructed in accordance with the generally accepted practice at the time of construction and which has been maintained to the intent there has been no significant loss of strength and serviceability.
Australian Standard means and refers to AS 4349.12007 – Part 1: Pre Purchase Inspections – Residential Building and Part 0: General Requirements, together with all Variations.
Building Element means a portion of a building that, by itself or in combination with other such parts, fulfils a characteristic function.
Major Defect means any defect of sufficient magnitude requiring rectification to be carried out in order to avoid unsafe conditions, loss of utility or further deterioration of the Property.
Minor Defect means a defect other than a Major defect.
2.1 Residential Buildings
The Inspection will be of those Building Elements defined in Clause 1.4.4 of Australian Standard AS 4349.12007 – Appendix C.
2.2 Strata Title
Inspection of a Strata Title Property will be carried out in accordance with Appendix B of Australian Standard AS 4349.12007.
2.3 Non Real Property Act Title
If the Property and buildings the subject of Inspection comprise non Real Property Act Title or Strata Title then the Building Inspection and Report:
2.3.1 will only inspect the interior and immediate exterior of the relevant Strata Title unit or Company Title unit requested by you; and
2.3.2 the Inspection and Report will be in compliance with Appendix B of Australian Standard AS 4349.12007 and not otherwise.
2.4 Acknowledgment by You
You acknowledge by entering into this Agreement that You should obtain an Inspection (and if necessary a Report) for all Common Property and Common Areas of any Strata Title property or any other non Real Property Act Title property before any binding Agreement is made with Us.
By ordering a Building Inspection and Report You acknowledge and agree that the Scope and Limitations set out below apply to Your engagement of Us.
3.1 Scope
The Building Inspection:
3.1.1 will be carried out in accordance with Australian Standard AS 4349.12007. The purpose of the Inspection is to provide advice to You and any prospective purchaser regarding the condition of the property at the date and time of Inspection;
3.1.2 will include Areas which are Accessible Areas only;
3.1.3 will comprise a visual assessment of those Items listed in Appendix C to Australian Standard 4349.1–2007 (Residential Buildings) for those structures within thirty (30) metres of the primary building and otherwise within the site boundaries, including fences;
3.1.4 will normally Report (subject at all times to Safe and Reasonable access) in writing on the condition of each of the following areas:
3.1.5 the Inspector will report in writing specifically on Major Defects and any relevant Hazards which are identifiable, evident and visible on the date and time of the Inspection. The Report will also provide a general assessment of the buildings and extent of Minor Defects, which would otherwise form a normal part of routine property maintenance; and
3.1.6 upon identification of a Major Defect, the Inspector will provide an Opinion in writing as to the nature of the Major Defect and will identify its location in the Building.
3.2 Limitations on Scope
By You entering into this Agreement with Pink Inspection Services You acknowledge the following Limitations apply to Our Building Inspections and Reports:
3.2.1 the Inspector performing the work will conduct a non-invasive visual Inspection, limited to those Accessible Areas and sections of the buildings to which Safe and Reasonable Access (see Definitions) is both available and permitted on the date and time of Inspection;
3.2.2 areas within which the Inspector is denied reasonable entry, or where Safe and Reasonable Access is not available, will be specifically excluded from, and will not form part of, either the Inspection or the Report;
Note: Such areas may be the subject of an additional Inspection and Report upon a request from You and after the provision of Safe and Reasonable Access
3.2.3 the Inspection will not involve any invasive Inspection whether by way of cutting, breaking apart, dismantling, removing or moving objects (including, but not limited to, roofing, wall and ceiling sheeting, ducting, foliage, mouldings, debris, roof insulation, sarking, sisalation, floor or wall covering, sidings, fixtures, floors, pavers, furnishings, appliances or personal possessions);
3.2.4 the Inspection excludes the inside of all walls other than those visually apparent, the inside of floors, skillion roofing, inside eaves, behind stored goods in cupboards and other areas concealed or obstructed;
3.2.5 the Inspector will not look for or report on any Timber Pest activity as You must separately order a Timber Pest Inspection from Us.
An Inspection by a fully qualified, licensed and insured Timber Pest Inspector for any Timber Pest Inspection which will be carried out in accordance with Australian Standard AS 4349.32010. We can assist You with those services but You have to engage Us separately. If You do so, Section C will apply to Timber Pest Inspections and Reports;
3.2.6 the Building Inspection and Report is based upon Our Acceptance Criteria; and
3.2.7 the Building Inspection Report is not a Certificate of Compliance and the Inspector will not warrant that the Property or the buildings on it comply with the requirements of any Act, Regulation, Ordinance, Local Law or ByLaw nor will a Warranty or any form of Insurance be given against problems developing with the building(s) at any time after the date of Inspection.
3.3 Magnesite Flooring
No Inspection for Magnesite Flooring will be carried out at the Property and no Report on the presence or absence (as the case may be) of Magnesite Flooring will be provided to You.
Note: You should ask the Owner whether Magnesite Flooring is present and/or seek your own independent advice from a suitably qualified Structural Engineer if Magnesite Flooring is present
3.4 Asbestos
No Inspection for asbestos will be carried out at the property. No Report on the presence or absence of asbestos will be provided in relation to the Property.
If, during the course of an Inspection, asbestos or materials containing asbestos are noticed by the Inspector, this fact may be noted in the General Remarks section of the Report. By entering into this Agreement You agree that a Notation as to the existence of asbestos or materials containing asbestos within the Property and buildings requires You to seek advice from a qualified asbestos removal expert as to the amount nature and relevance of the asbestos present, and the cost of sealing or removal of it.
3.5 Mould (Mildew) and Non Wood Decay Fungi
No Inspection or comment in the Building Report will be made for Mould (Mildew) and Non Wood Decay Fungi. You should make and rely upon Your own enquiries and Inspection.
3.6 Occupied Buildings
If the Property or buildings to be inspected is occupied by any Person then You must be made aware that furnishings or household items may conceal evidence of building problems, evident only upon removal of those furnishings or household items. The Inspector will indicate in the Building Report whether or not the Property was occupied or appeared to be occupied at the time of Inspection. We recommend that You:
3.6.1 obtain a Statement or written Acknowledgement from the owners of the Property as to whether there has been at any time:
3.6.1.1 any Timber repairs or other repairs; or
3.6.1.2 any alterations or other problems to the Property disclosed or known to the Owners; and
3.6.2 in all other respects You agree that You will indemnify the Inspector and Pink Inspection Services from (and otherwise and accept liability for) any omission or failure on the part of the Inspector of Pink Inspection Services to report in the Building Inspection Report a defect which was concealed by the owners or agents of the buildings being inspected and You expressly waive any right to seek compensation against us for any Loss or Claim in that regard.
3.7 Non Report of Items
The Building Inspection Report will not cover or report on any of the Items listed in Appendix D to Australian Standard AS 4349.12007.
3.8 Weather Conditions
The Inspection and Building Report will not report on any defects which are not apparent due to prevailing weather conditions at the time of the Inspection and You acknowledge that some defects in the buildings may only become apparent in weather conditions that differ from the weather conditions applying at the time of Inspection.
3.9 Further Disclosure
You should also note:
3.9.1 the Building Inspection Report will be prepared and presented, unless expressed in writing otherwise, on the assumption that the existing use of the Buildings will continue after the date of Inspection as Residential Property; and
3.9.2 where the Building Inspection Report recommends some other type of Inspection (including an invasive Inspection) then You should have such an Inspection carried out prior to the exchange of any Contract for Sale or the expiry of any Cooling Off period under a Contract for Sale or rely on your Own legal advice. In the event that You fail to follow our recommendations (whether in writing or otherwise) then You acknowledge, agree and accept that You may suffer a financial loss and You indemnify us against all losses or any other Loss or Claim that You may incur arising from any failure to act on our recommendations and advice.
If You engage Us to carry out a Timber Pest Inspection and Report at the Address nominated by You Section A and the following further provisions of Section C will apply to this Agreement.
Active means that live Timber Pests were sighted during the Inspection.
Australian Standard means and refers to AS 4349.32010 – Part 3: Timber Pest Inspection.
High Moisture Readings means a reading on a moisture metre that is higher than the readings obtained in other parts of the Property.
Note: Such high readings should be investigated by invasive means as the presence could indicate a water leak or may indicate Timber Pest activity and damage
Inactive means that no Active (see above) Timber Pests were detected but evidence such as workings, damage, mudding or exit holes was found at the time of Inspection
Note: Where visual evidence of Inactive termite workings and/or damage is located, it is possible that termites may still be Active in the immediate vicinity and the termites may continue to cause further damage. It is not possible, without the benefit of further investigation and Inspections over a period of time, to ascertain whether any Infestation is Active or Inactive. Continued, regular Inspections are essential to determine whether Active Timber Pests exist.
Termites means subterranean and dampwood termites (white ants) and does not include Dry Wood termites.
Timber Pests means Subterranean and dampwood termites, borers of seasoned timber and wood decay fungi(rot) but does not include Drywood termites.
2.1 Nature and Compliance with Australian Standard
Pink Inspection Services will carry out its Timber Pest Inspection and Report in accordance with the Australian Standard and to provide appropriate advice by way of Report in relation to the condition of the Property identified by You relevant to Timber Pest activity and Damage (if any) only.
2.2 Non Invasive
All Inspections will be non-invasive and comprise visual Inspection limited to those areas which comprise Accessible Areas or an Access Hole in the building which results in Safe and Reasonable Access to Our Inspector.
2.3 Use of Equipment
The Inspector may use a probe or screwdriver to tap and sound some timbers and may use a sharp knife to carry out some “splinter testing” on structural timbers in the subfloor and/or roof void. The Inspector may use a moisture meter to check moisture levels in walls that back onto wet areas such as showers etc. Other than these areas the moisture meter will not be used on other surfaces except where the visual Inspection indicates that there may be a need to further test the relevant area.
By ordering a Timber Pest Inspection and Report You agree that the Scope and Limitation set out below apply to Your engagement of Us.
3.1 Scope
The Timber Pest Inspection:
3.1.1 will be carried out in accordance with Australian Standard AS 4349.32010 – Part 3: Timber Pest Inspection.
The purpose of the Inspection is to provide advice to You and any prospective purchaser regarding the presence of Active Timber Pests or evidence of Inactive Timber Pests in the Property at the date and time of Inspection.
3.1.2 will include Areas which are Accessible Areas only;
3.1.3 will comprise a visual assessment of those Items listed in Appendix F to Australian Standard 4349.3–2010 (Timber Pests) for those structures within thirty (30) metres of the primary building and otherwise within the site boundaries, including fences.
3.1.4 will normally Report (subject at all times to Safe and Reasonable access) in writing in relation to each of the following areas:
3.2 Limitations on Scope
Timber Pest Inspections and Reports will be provided in the following manner:
3.2.1 they will be confined to reporting on the discovery of any infestation and/or damage caused by Subterranean and Dampwood Termites (White Ants), Borers of seasoned timber and wood decay fungi (rot) which are present and capable of visual Inspection at the date and time of Inspection;
3.2.2 the Report will not include any comment on any other pests and the Report will not comment on them. Drywood Termites (Family Kalotermitidae) and European House Borer (Hylotrupes bujulus Linnaeus) will be excluded from the Inspection;
3.2.3 the Inspector will report evidence of any earlier Termite treatment but the Client must assume that such Termite treatment was curative at the time of treatment and should then obtain statements or other evidence from the Vendor as to any earlier treatment and must then make and rely on their own enquiries;
3.2.4 the Inspection and Report cannot and will not guarantee that damage and/or Timber Pest infestation does or does not exist in inaccessible or partly inaccessible areas or sections and it cannot make any guarantee or comment on potential future infestation of Timber Pests;
3.2.5 Nothing contained in the Report will imply that any inaccessible or partly inaccessible area(s) or section(s) of the Property are not, or have not been, infested by Termites or Timber Pests. Accordingly, the Report will not guarantee that an infestation and/or damage does not exist in any inaccessible or partly inaccessible areas or sections or the property. Nor can it guarantee that future infestation of Timber Pests will not occur or be found; and
3.2.6 Mildew and non wood decay fungi are commonly known as “Mould” and is not considered a Timber Pest but may be an indicator of poor ventilation or the presence of Termites, wood decay or water leaks. Mould and their spores may cause health problems or allergic reactions such as asthma and dermatitis in some people.
3.3 Occupied Buildings
If the Property or buildings to be inspected is occupied by any Person then You must be made aware that furnishings or household items may conceal evidence of building problems, evident only upon removal of those furnishings or household items. The Inspector will indicate in the Building Report whether or not the Property was occupied or appeared to be occupied at the time of
Inspection. We recommend that You obtain a Statement or written Acknowledgement from the owners of the property as to whether there has been at any time:
3.3.1 any Timber Pest Activity or Damage;
3.3.2 any Timber repairs or other repairs;
3.3.3 any alterations or other problems (relevant to Timber Pests) to the Property known to the Owners;
3.3.4 any other work which has been carried out to the Property (including Timber Pest Treatments).
3.3 Indemnity and Waiver
You agree that You will indemnify the Inspector and Pink Inspection Services from and otherwise and accept liability for any omission or failure on the part of the Inspector of Pink Inspection Services to report in the Timber Pest Inspection Report a defect or infestation which was concealed by the owners or agents of the buildings being inspected and You expressly waive any right to seek compensation against us for any Loss or Claim in that regard.
3.4 Property – Strata/Company Title
Where the Property is Strata Title or Company Title only the interior and immediate exterior of the specified Property and the dwellings on it will be inspected by the Inspector in compliance with Appendix F of Australian Standard 4349.3 – 2010 (Timber Pests).
You acknowledge by entering into this Agreement that you should obtain an Inspection (and if necessary a Report) for all Common Property or all Common Areas of any Strata Title Property or any other non Real Property Act title property before any binding Agreement is made with Us.
4.1 Your Obligations
In the event that the Inspector provides comment on Timber Pest damage to part of the structure or the grounds of the Property You must assume that there may be other damage (including structural damage) within the building and a suitably qualified Person (for example Engineer, Architect or Builder) should be engaged by You to carry out a structural Inspection and identify the extent of repairs and/or damage reasonably required at the Property.
4.2 Invasive Timber Pest Inspection
In the event that the Inspector comments on the existence of Timber Pest damage and/or activity You should assume that there may be damage in concealed areas and You should specifically engage Us to carry out and prepare an Invasive Timber Pest Inspection and Report, which must be the subject of a separate Agreement with Us. We do not accept liability for damage to a concealed area or an area to which Safe and Reasonable Access is not available.
